1. Legal Basis

According to the provisions of the Civil Code (Articles 556 and following), as the seller, we are liable to the Customer who is a consumer for physical and legal defects of the sold goods (statutory warranty). The statutory warranty is valid for 2 years from the date the goods are delivered to the Customer.

2. What is a defect?

A physical defect means the goods are not in conformity with the contract, in particular if:

  • the goods do not have the properties that they should have due to the purpose specified in the contract or resulting from circumstances or intended use,
  • the goods do not have the properties that we assured the Customer of,
  • the goods were delivered incomplete.

A legal defect occurs when:

  • the goods are owned by a third party,
  • the goods are encumbered with the rights of a third party,
  • restrictions on the use or disposal of the goods result from a decision or ruling of a competent authority.
  • 3. Customer rights under the statutory warranty

If a defect is found, the Customer has the right to:

  • request replacement of the goods with new ones,
  • request repair of the goods,
  • submit a statement on price reduction,
  • submit a statement on withdrawal from the contract (if the defect is significant).

The seller may propose an alternative solution if the Customer’s choice is impossible to fulfill or would involve excessive costs.
